COVERED GOODS
Imported polysilicon and polysilicon derivatives specified in Annexes I and II, including polysilicon, polysilicon ingots and wafers, solar cells and solar modules. The Federal Register publishes the annexes as images, so the HTS lines are not listed here; see the source.
EXCLUSIONS
For Japan, Korea, Taiwan, Switzerland, Liechtenstein and EU goods, the Section 232 duty plus Column 1 duty equals 15 percent. UK goods face 10 percent under clause 4. Approved onshoring plans can allow imports of necessary production equipment and covered products without applicable Section 232 duties. Manufacturing drawback is available for certain Trade Agreement Partner goods meeting stated conditions.
USMCA
Canada and Mexico are listed as Trade Agreement Partners for manufacturing drawback if the article meets the stated conditions, including polysilicon content composed entirely of polysilicon from a Trade Agreement Partner country. No general USMCA duty exemption is stated.
WHAT TO DO (OUR GUIDANCE, NOT LEGAL ADVICE)
Identify SKUs that are polysilicon, ingots, wafers, solar cells or solar modules and confirm whether they fall in Annexes I or II once HTS details are available. Prepare entry documentation for MIP compliance before December 4, 2026 and review whether any supplier contracts predate the signing date.
