COVERED GOODS

Covered Products described in the Annex: certain advanced computing chips and certain derivative products. The Federal Register publishes the Annex as images, so the HTS lines are not listed here; see the source.

EXCLUSIONS

The duty does not apply to covered products for use in U.S. data centers, U.S. repairs or replacements, U.S. research and development, startups, non-data center consumer applications, non-data center civil industrial applications, U.S. public sector applications, or other uses the Secretary determines strengthen the U.S. technology supply chain or domestic manufacturing capacity for semiconductor derivatives.

WHAT TO DO (OUR GUIDANCE, NOT LEGAL ADVICE)

Identify whether imports are Covered Products once the Annex or implementing HTS notice is available. For potentially covered chips and derivative products, document end use because the proclamation lists U.S. use-based carve-outs.
