COVERED GOODS
Medium and heavy-duty vehicles, medium and heavy-duty vehicle parts specified in Annex I, and buses and other vehicles classified in HTSUS heading 8702. The Federal Register publishes the Annex I as images, so the HTS lines are not listed here; see the source.
EXCLUSIONS
The tariffs do not apply to MHDVs or buses in HTSUS heading 8702 manufactured at least 25 years before entry. USMCA-qualifying individual MHDVPs are not subject to the additional duty until Commerce and CBP establish a process for applying the tariff to non-U.S. content, but knock-down kits or equivalent parts compilations remain subject to duty. Certain U.S.-assembled MHDV and engine manufacturers may use import adjustment offsets, but knock-down kits or equivalent parts compilations are not eligible for offsets.
USMCA
For USMCA-qualifying MHDVs other than buses and heading 8702 vehicles, approved importers may apply the 25% duty only to non-U.S. content. USMCA-qualifying individual MHDVPs are not subject to the duty until a non-U.S. content process is established, except knock-down kits or equivalent parts compilations.
WHAT TO DO (OUR GUIDANCE, NOT LEGAL ADVICE)
Check truck, bus, and parts entries for MHDV coverage and HTSUS heading 8702 before November 1, 2025. For USMCA goods, prepare documentation for U.S. content and watch for the Federal Register notice establishing the MHDVP non-U.S. content process.
