COVERED GOODS

Automobiles and certain automobile parts, including passenger vehicles, light trucks, engines and engine parts, transmissions and powertrain parts, electrical components, and articles specified in Annex I or later annexes. The Federal Register publishes the Annex I as images, so the HTS lines are not listed here; see the source.

EXCLUSIONS

USMCA automobiles may be approved to apply the 25 percent tariff only to the non-U.S. content value. USMCA automobile parts are not subject to the 25 percent tariff until Commerce and CBP establish a process, except this does not apply to knock-down kits or parts compilations.

USMCA

For qualifying USMCA automobiles, importers may submit documentation on U.S. content and, if approved, apply the 25 percent tariff only to non-U.S. content. Qualifying USMCA automobile parts are not subject to the tariff until a process is established for applying it only to non-U.S. content.

WHAT TO DO (OUR GUIDANCE, NOT LEGAL ADVICE)

Classify imported vehicles and parts against the official annex or later Federal Register notices, and request supplier support for USMCA status and U.S. content. For USMCA automobiles, prepare documentation for Commerce approval; for parts, watch for the Federal Register notice establishing the non-U.S. content process.
