TARIFF TRACKER
Imposes a 40 percent IEEPA duty on certain products of Brazil
This order imposes an additional 40 percent duty on articles of Brazil, with exceptions for Annex I goods, IEEPA statutory carve-outs, certain in-transit goods, and goods subject to Section 232 actions. The duty stacks with the reciprocal tariff under Executive Order 14257 when that order applies.

COVERED GOODS
Articles of Brazil imported into the customs territory of the United States, except goods covered by 50 U.S.C. 1702(b), goods listed in Annex I, certain in-transit goods, and goods subject to existing or future Section 232 actions. Annex II modifies the HTS. The Federal Register publishes the annexes as images, so the HTS lines are not listed here; see the source.
EXCLUSIONS
Excludes goods encompassed by 50 U.S.C. 1702(b), goods set forth in Annex I, goods loaded and in final transit before the effective time and entered before 12:01 a.m. EDT on October 5, 2025, and goods subject to existing or future Section 232 actions. The text says Annex I includes certain silicon metal, pig iron, civil aircraft and parts and components, metallurgical grade alumina, tin ore, wood pulp, precious metals, energy and energy products, and fertilizers.
WHAT TO DO (OUR GUIDANCE, NOT LEGAL ADVICE)
Check whether Brazilian-origin SKUs fall within the order and whether any are covered by the named exclusions, in-transit rule, or Section 232 actions. Annex I and Annex II are published as images, so verify the actual HTS provisions in the source before repricing or entry filing.
